BEWARE WHEN BUYING FROM THIS SELLER!!!

There are copies of emails and everything that was said as well to show that I am in fact telling the truth.
this seller is a liar and a cheat and you should buy form her with caution, if at all.

If it is too much reading, below is just a gist of how manipulative she can be.

This seller is a liar and does not follow ebay policy!!! I purchased a car from this person, and they could not have been more of a rude, lying, stealing and manipulative person then they made it clear to me they are. When purchasing this car, I had full intention on paying for it and made that clear to the seller. We are in the United States Air Force and are stationed in England currently. My husband was on his motorcycle and got hit by a car, for which we have a large settlement coming from. He had a broken femur as well as numerous other injuries, and needless to say his motorcycle was totaled. The insurance company of the other driver is to pay for the damage of the motorcycle, and my husband and I agreed that he would get a car instead of another motorcycle. We purchased this car after being told the check was on its way a week prior. We are not the type of people to jump into a purchase this large without having prior plans. This seller, harleygirl383 gave us a very hard time. When my husband was talking to her, she got him so worked up he literally got very angry with her. We sent her the $200.00 deposit almost immediately after we purchased the car. The day after we purchased the car we received a letter in the mail saying that there was no third party insurance in place, and the driver of the car was not covered. As you can imagine, this was quite a shock to us, as we were told he had insurance and everything was covered. They were even in contact with the other persons insurance, so they told us, and sent us an estimate on how much we were going to receive. We were even told the check was in the mail, as I stated above. We contacted the seller and let her know what was going on, and she agreed with us to not complete this transaction. We even provided her copies of the estimate and court paper saying the man was not covered. After 1 week of no full payment with us contacting her and letting her know what was going on, she gave us an unpaid item strike, which in turn cancelled our ebay membership.

After talking with me, she said she was unaware that she could have filed a mutual agreement that we both agreed to not complete the transaction. Despite how rude she was in the prior messages, she actually seemed nice. Now, if you are familiar with ebay policies, then you are aware this is how it works: If you come to a mutual agreement with someone, you file a dispute saying so. When the dispute closes, you are eligible for our Final Value Fee credit. Once the dispute is closed, you can relist the item and if it sells you get a Insertion Fee Credit as well as a Relisting Fee Credit. This woman, (I'm using that term loosely) filed a dispute saying I was a nonpayer and while the dispute was open relisted her car, stating she knows ebay policy. After I contacted her, she removed the strike for me, and it took her credit back that she was issued. Now, keep in mind I paid a $200.00 deposit. She now refuses to return my deposit because she feels it should pay for her ebay fees, which she would have gotten credited, if she had done it correctly. I offered to help her with the ebay customer service to get these fees credited back to her. I did help her, she got one credit back, and was waiting for the other ones, she said. Even with getting a large credit back to her account, she still refused to return my money. I had found out that I could report her to ebay Trust and Safety department for her not following ebay policy. I informed her of this, and she told me to do what I had to do on my end. So, I did.

I filed with eBay Trust and Safety, as well as a Dispute with PayPal to try and recover my money. Now please keep in mind we had been communicating by email for over a month, I helped her to get her money back and she was well aware that this was a mutual agreement to not complete the sale. After I filed a dispute with PayPal, almost 2 MONTHS after this auction, she goes and leaves me negative feedback, saying the very same thing she had said in the beginning before all of this, 'Did not pay 4 car. DEAD BEAT BIDDER. NO MONEY DONT BID' I was shocked. After all of this, she went and left me negative resorting back to what she knew was not true? I sent her a message and informed her I will be doing the same, as this was not right in any form. We sent about 4 messages back and fourth, her saying the same thing she did in emails and talking about the PayPal dispute. I told her I will except $100.00, that is a loss for me from her to cover her ebay listing fees, which were her fault any how, and for her to remove the Negative Feedback and I would close the dispute. Now something you have to understand about PayPal is they do not cover cars. No matter what, they will not give you your money back. The dispute was a last resort for me, as no one on ebay has been able to help me recover my money. I put a reply on my negative saying the truth, as we both knew it, 'we AGREED to not complete sale! seller took my $200 & left negative! BAD EBAYER!' What would you do? I hadn't even left her negative yet. So she actually had the gaul to, in the midst of us messaging back and fourth yet, do a FOLLOW-UP to my reply!! 'NO agree.made.I shoudnt b out money for fees cause u didnt follow through w. dea' PLEASE!!!! This woman, ruthless and a liar, got away with my money, AND hurt my ebay rep in the process!!! I can not believe people can be so undeniably cruel, and this woman has proved that She is.. I have no nice words to call her.

So I am doing this as my one last say, to inform anyone interested in purchasing ANYTHING from her, ESPICALLY A CAR, DO NOT DO IT!!! She will take your money and run!! This is not someone who should be doing business on ebay, or even with people. She is just plain a mean, bad person and over all a liar, who you do not want to have the displeasure of dealing with.

Below are copies of all of the emails sent and received, the email addresses have been taken out for security. It is starting with the Dispute, as eBay deleted all other the prior messages.

Hi Donna,
We have contacted the company that is dealing with getting our settlement for the motorcycle
, and they said they are contacting the insurance company to assure we get this money. However, it
should be more then a week before we get the check, what would you like to do? Are you willing to
wait a little longer for us to pay you or would you like to just refund the $200.00 and end the
transaction between us? Please let me know once you know what you would like to do
Talk to you
soon

I had to relist corvette. It cost me more than that in listing fees and phone calls.

kieshyiah Sep-20-06 at 04:16:58 PDT

If you had done it correctly you should not have had to pay any fees. That is what I was trying to
help you avoid. All you had to do was a dispute saying we agreed not to complete the transaction and
your fees would have been refunded as well as relisting fees. For your inability to do this correctly
, we should not have to lose our money. I will be filing a dispute with paypal if you do not agree
to return it. I was nice to offer the listing fees out of my money, its sad it has to be this way.

harleygirl383 Sep-20-06 at 04:56:21 PDT

If you dont have money dont bid. Go ahead file a complaint so far it cost me 95.00 for the first ad
and 45.00 for second plus long distance phone calls. I will double check the amount because i just
got my invoice. We wouldnt be in this mess if you didnt bid when you dont have any money. After i
read invoice and get phone bill i will give you difference but it wont be much.

kieshyiah Sep-20-06 at 05:21:57 PDT

In your auction description it says $200 is to be paid within 24 hours which was, and for the rest
you said, unless other arrangements are made which is what I was attempting. I made sure this was in
the description, as it mattered to my situation. As far as your listing fees as I had explained, I
should not be responsible for. If you had been knowldegable in the functioning of ebay you would not
have had to pay so much. It is not any fault of mine that you did not do it correctly.

kieshyiah Sep-20-06 at 05:24:11 PDT

I will be seeking $150 for a return, which is me paying for your relisting fees and a partial amount
of your phone bill. I could not see the phone bill being any more then that, as you said it was your
cell phone. Once this dispute closes, you should be elidgable for the other fees to be refunded to
you FROM EBAY as you should have done in the beginning. Next time, I advise you understand how all
of this works before taking peoples money.

harleygirl383 Sep-20-06 at 16:51:35 PDT

Sorry but i dont own a cell phone. I have done everything correctly. I only bid when i have money.
You found out how much it was going to be for shipping and it was too much. Your story was kind of
funny. Who would not insure their husband. Insurance co. always ask if any other drivers or if you
are married. I would of sold the vette for 6100.00 if you wouldnt of jumped in at the last money.

harleygirl383 Sep-20-06 at 16:53:30 PDT

Have money before you bid. Find out how much shipping is. I know what i am doing on ebay.

Donna,

I read your last message you left before ebay cancelled my acount due to your unpaid item strike, and just wanted to clarify things with you. Below is the shipping quote that we recieved, which was in no way 'too much'. We are recieving over $8,000 and the shipping quote was actually much less then we had expected. This car was to replace my husbands motorcycle, after the accident I prefered he wouldent drive one for a while. We used to have a Superchared Camaro SS that was his baby, so we agreed on this car to ease his 'need for speed'. For the motorcycle, we got a quote of approx. $8,910 (4,950 Pounds) for the check that we would recieve, the quote is attached. We bid on your car on Sept. 11th, and had been watching it for most of the auction. Prior to recieving the physical quote, they spoke with us on the phone and told us the amount a little more then 1 week prior. The physical quote was recieved on Sept. 8th (As dated). Also attached is a copy of the letter from the Norfolk County Criminal Justice Unit, as we had told you about, stating there was no third party insurance in place. We recieved (as dated on the letter) this letter on Sept. 12th, the day after we won the auction. Obviously, this was not expected and made things very difficult for us. We have been nothing but honest with you, every step of the way, to make sure you knew what was going on. Perhaps we should have sent you copies earlier. To lose this money we had in paypal was a big thing to us, due to the fact of the money we have had to put out for all of the things involved with his accident and then finding out we have to battle in court and might not recieve a dime. I just want to assure you we had every intention to pay when bidding on this car. Due to my need for making money on ebay, (I am a stay at home mom) I would greatly appreciate it if you could remove the unpaid item strike so my account will be reactivated. It is sad but it seems the only way they will reinstate it is if you remove the strike. I contacted paypal about the $200 and they informed me that there is nothing we can do, as they do not cover cars. So I guess you get the money regardless of the fact you will get a credit for the auction we bid on from ebay. It is just the principal of the situation that I contact you and let you know we were not 'dead beat bidders'. As I said above, everything is attached for you. Please look it over and contact me to assure you recieved it. I scanned them into Adobe Acrobat .pdf files, please let me know if you don't have Adobe, I can make them into a picture file. If you could remove the unpaid item strike I would be very grateful. Thanks for your time and sorry about all of this mess, just know it was all out of our control.

Thanks again, Merry

I will go over this when i get home from work. If it was your husband writing me yesterday, he wasnt very nice. Nobody tells me that i am not doing this correctly. Evidently i know what i am doing. All you had to do was to let me know in advance what was going on. I kept emailing you after the auction was over and no response til thurs.(i think) i would have to look. I will go over things when i get home from work. Your emails are nicer than his and didnt make me mad.

That sounds good, do you have Adobe Acrobat? Just let me know if you dont and I will send you the files in .jpg format. Sorry it took so long to email you, we explained all of that I think in the email we sent.. things have just been really hard latley, it seems to be one thing after another. I wont bore you with the details, but lets just say, things havent been going well sence his accident. I have been busy with our daughter and prepairing for his mother visiting us, as well as making phone calls to try to sort this legal mess out, we haven't had much time to sit at the computer. I tried to give you as much information as I could in the email we sent after the auction about what was going on, I hope the copies of the actual documents help ease your mind in the fact that all of our intentions were legit.. look forward to hearing from you soon.

Im not worried about that. Let me talk to my husband when i get home from work. I will probably just remove the unpaid strike item and leave it at that. But you guys keep talking about the fees. The only fee i got back was for 40.00 for the final value fee. When i remove this strike i will have to pay it. The first listing fee was for 50.00 then the final value fee of 40.00 which right now was credited to my account and a 50.00 relist fee i had to pay. If i would get all of this back i would probably reimburse you. If your husband wasnt so rude in his emails we wouldnt be doing this. Me and him are probably too much alike both with attitude and a temper which dont mix. You sound very nice thats why we are considering doing this. My husband is too nice like you too. Thanks Donna

Sent on: 9/22/06 6:53:36 AM

What you should do, if you can, once the unpaid item strike is removed, do a dispute saying we agreed not to complete the transaction. On my end, it will give me the choise to let you be reimbursed, and I will make it so you can. You sould still recieve the credit. Hehe, yeah, us couples tend to have one with a flare and one who is a softey, they're the best matches. ;) It should reimburse you for most of the fees, just let me know what it gives you as a credit after we do the distpute, so I can be sure. But I am positive, if we do it that way, you will get the credit back. Hope to talk to you soon

Nothing Received.

Sent on: 9/24/06 2:31:15 PM

Hi there, just checking in to see if you have been able to remove the stirke yet? I'm not sure if you Received. my other email, but I know you will get the credit back if we file the dispute a differnt way.

Hope to hear from you soon, hope all is well

Hi Merry, i took the unpaid item strike off and it reversed charges for the final value fee of 40.00. Im not sure its going to let me get a refund for all unless you know how to do it. Let me know. Donna

Sent on: 9/26/06 5:17:35 AM

Thanks so much. All you have to do is file a dispute saying we agreed not to complete the transaction. It will give me the option to make you so you can get the credit back or not, and I will make it so you can get it back.

Let me know when you do this, they should give you a final value fee credit as well as a listing fee credit.

Received on: 9/26/06 7:12:41 AM

Im not sure how to do that. I went to file a upaid complaint because i know what you are talking about because i seen that option the first time but not sure how to do it after we been through this. It wouldnt let me file another complaint on that item number.

Sent on: 9/26/06 3:43:05 PM

thats because my account isnt reinstated yet.. i contacted ebay and am waiting for them to let me know why it hasent been fixed yet. once it is, i will walk you through how to file the dispute. i should get a response from them in 24-48 hours they said.. is that ok?

Allright,

what you have to do is send this message to ebay customer support (if you need the direct email address ill get it for you) :

Hi, I have agreed not to complete the transaction for item # 270025680836 with the bidder. However, when I go to file the dispute it says one has already been filed. I need to do this to apply for my listing credits I am eligable for. If you could please make it so I can do this, or issue me the credit deserved that would be great.

Thanks Donna

6:36:41 PM Conrad E. I apologize for the hold time. Thank you so much for your patience. My name is Conrad, welcome to Live Help. How may I assist you today?
6:37:25 PM You there was a dispute difled from a seller against me, and they did not know they could file a dispute saying that we agreed not to complete the transaction
6:37:44 PM You instead they did an unpaid item strike
6:37:52 PM You me to an agreement and they removed the strike
6:38:24 PM You w they would like to do it the correct way and file it as we agreed not to omplete the transaction
6:38:31 PM You s they have already filed a dispute
6:38:39 PM You it will not let them
6:39:48 PM Conrad E. Just to clarify, your seller wants to file the dispute but the system won't allow them?
6:40:29 PM You yes, they want to file a dispute saying we agreed not to complete the transaction
6:41:00 PM You but sence they already had one opened then closed, the system will not let them
6:42:06 PM Conrad E. I see. I'm sorry for any inconvenience. I just want to make sure that I understand this matter completely. Your seller have filed a dispute for that item before and now they want to file another one for the same item to remove the strike on your account?
6:42:26 PM You no
6:43:00 PM You the seller had filed a dispute, saying i did not pay and gave me an unpaid item strike
6:43:40 PM You i spoke with them and they removed the strike, but did not know they could file a dispute saying we agreed not to complete the transaction
6:44:15 PM You they would like to file this dispute, but are not allowed to due to a dispute already having been opened on the item
6:44:30 PM You do you follow?
6:44:38 PM Conrad E. I see. Thanks! Yes, they could have close the dispute by choosing the third option that states you both agree to back out of the transaction.
6:45:08 PM You they alrady have done that
6:45:23 PM Conrad E. I understand your concern. I regret to tell you that the seller can't file a dispute anymore since they have filed it before for the same item.
6:45:53 PM You they need their credit that was taken back once they removed the strike
6:46:58 PM You what do they have to do to recieve their credit back for their listing fees and such?
6:47:35 PM Conrad E. Actually, when they have closed the dispute, the final value fees have been credited back to them and they can relist the item for free.
6:48:23 PM You when they gave me a strike they got the credit, when they removed the strike ebay took the credit back
6:49:44 PM Conrad E. Closing the dispute will escalate it and allowing the sellers to have their final value fees back and relist the item for free. Even if the seller will remove the strike, eBay won't take back the final value fees.
6:51:02 PM You they relisted it before the dispute was closed
6:51:36 PM Conrad E. I see. That is the reason why the listing fees were still charged to them.
6:51:51 PM You so they did not recieve the relisting credit and they told me ebay took back the credit that was given to them
6:52:12 PM Conrad E. They should have waited for the dispute to be closed before they relisted the item.
6:52:13 PM You what can they do to get this situation fixed and recieve the credits that are rightfully theirs?
6:53:56 PM Conrad E. What I recommend is that your seller contacts our Billing chat on this link to credit the listing fees back. They can reach our Billing team through here: http://pages.ebay.com/help/account/livehelp-billing.html?MfcISAPICommand=GetResult&SortProperty=MetaEndSort&ht=1
6:55:12 PM You and they should sort everything out for them?
6:55:33 PM Conrad E. Yes, our Billing team can sort this out for your seller.
6:55:47 PM You thanks i will let them know

Received on: 9/29/06 7:48:03 PM

Hi Merry, i wrote to ebay but still have not heard anything. How long should i wait or what should i do next.

Received on: 10/3/06 7:34:27 PM

I dont know what else to do. I guess you have to do what you think. Nothing was credited back to my account as of 7;30 on Tuesday. I do not have to refund deposit because you did not follow through with the deal and i still had to pay fees. I shouldnt be out this money either. I am going to get ahold of ebay and see what they say. Thanks

Sent on: 10/3/06 12:45:19 PM

I figured i would contact you abour this as well, as I dont want to do this but it was suggested to me..

I asked about the deposit, and this is what the ebay customer support said:

6:56:13 PM You when i purchased the item i paid a deposit of $200
6:56:26 PM You not complete the transaction, and the seller will not refund this money
6:57:46 PM Conrad E. If the transaction is not completed, your seller should refund the deposit to you.
6:58:16 PM You they said they are keeping it for the fees
6:58:50 PM Conrad E. There's no need to keep the deposit since all the selling fees will be credited back to them.
6:59:20 PM Conrad E. I can help you report this seller to our Trust and Safety team! Will that be okay with you?
7:00:32 PM You i would like to contact them one more time and see if they will return it

i dont want to report you, because i dont know what they will do, but this is ebay policy and this person has said that you will get all of your fees credited back to you.. please let me know what you would like to do about this, im sure there is some way we can resolve it without having to go through ebay and getting another account suspended. I don't want to do that to you, as I know how it feels. =P

So far they did credit my account 80.00. I have a credit cause i already paid for everything. They sent me website to go to and try to get relisting credit back. It takes time. I will be going to that probably this weekend. I need to see if they will send me a check for the credit we already sold everything wont be listing anything else right now . We had 2 good friend die and it has taken a toll on me.

If you know how to get my 80.00 credit back let me know or i will get in contact with them.

We did not say anything else to each other for about a week, I then Filed with the Trust and Safety Department and Filed a Dispute with PayPal. The Dispute said: I sent a deposit of $200 to this seller, we agreed not to complete the transaction and now they refuse to give me my money back. They say it is for their ebay fees, yet ebay has already reimbursed them with most of their credits, I do not feel I should have to wait for this. On their auction, it no where said the deposit was non refundable. I was told from ebay's trust and safety department to contact paypals dispute console and file a dispute. I am tired of getting the runaround, go here, do this but no one is able to help me with it becides filing claims, all I would like is my $200 back. Please help with this, there has to be some protection for me to be able to get my money back when a deposit like this is paid. As I had anticipated, PayPal canceled the dispute because they do not cover cars. After I opened the dispute, harleygirl383 left me negative feedback stating, 'Did not pay 4 car. DEAD BEAT BIDDER. NO MONEY DONT BID' I sent her a message regarding this and we communicated a little more.

Our eBay Messages:

Sent on: October 25th

How dare you leave me negative feedback, after all of this. I told you I had to file these things, beacuse according to ebay policy you should have refunded my desposit. YOU said for me to do what I had to do. We had agreeed not to complete the transaction, I provided you proof, and we have even been trying to resolve this other ways! I even helped you! For you to turn around and do this was wrong, and showed me what kind of person you actually are. I am leaving you negative feedback in return, I didn't have to be like this. If you change your mind, we can mutually withdraw the feedback, because this will hurt YOUR rating too.

Received. on: October 25th

Ok let see. Its not ok if i put a upaid item strike on your acct. but it is ok to turn me in because you did not pay for car. I offered to give the partial refund back they credit my acct. 80.00 so far i was almost there all i needed was the relisting fee back and then all of this would of been settled. I was waiting on response. and trying to get the 80.00 they credited my account. I should have to pay for the fees cause you didnt pay for the car.

Sent on: October 25th

Turning you in? I did what the customer service told me to do, because to this date I have not Received. any money back. It has been over a month and a half, and no where in your auction did you state the deposit was non refundable. When you got the $80, you should have given me back my money. I shouldent have to wait until you recieve all your credits, because you will get them. I was told it was against ebay policy what you did, and I have just been following ebays steps for them to recover my money. I also filed with them because there is only a certain time window in which I have that they will help me, and in 1 week that window will be closed. I coulden't wait till it was closed incase you decided you got your refunds and didn't want to give me my money back anyhow, then I would have for sure taken a loss. Even with some of the things I could have done I cant any more, because it is over 30 days. Do you understand?

No im not sure i understand. I am talking to paypal cause we closed account on 9/13/06 so i am talking to them. I offered to give you back the 80.00 plus the diffence that was left over. I shouldnt be out of the fees cause you didnt have money to pay for the car. If you guys didnt jump in at the last minute it would of been sold at 6100.00. I relisted it didnt sell so i dont think they are going to credit the relisting fee. I shouldnt have to pay for. Well anyways i am talking to paypal about account. I just waiting on response. It all take time.

I am sorry if you do not get your relisting fee back, you should have waited till the dispute was closed and did it that way. Did you try a second chance offer? You did not offer me back any money, or I would have said yes. If you return only $100, I will take a loss and pay for your relisting fees. In this case, you would also have to withdraw your negative feedback, and I will close the dispute with paypal.

Received. Nothing.

At this point, I did what anyone would do and defended myself in a reply on the Negative Feedback. I said:
'we AGREED to not complete sale! seller took my $200 & left negative! BAD EBAYER!'

She did a follow-up on my reply to her Negative Feedback: 'NO agree.made.I shoudnt b out money for fees cause u didnt follow through w. dea'

I will try and help you with getting your credits back if you want, sorry your new at this. I have been selling for a while, and am firmiliar with ebays procedures. How it works is if you come to a mutual agreement, there is a different dispute you file, that does not give the buyer a strike. When the dispute closes, you get a final value credit. If you relist the item after the dispute closes and the item sells, you get a relisting fee and insertion fee credit to your account. I would just like $100 back and the negative feedback removed, and I will close the dispute with paypal. Can you do this?

I did not try second chance offer cause they was from out of the country too not doing that again. I told you i was in the process of getting the 80.00 back they credit my ebay seller account well i already paid my bill. They need to send that to you or me. I cant get a response from ebay. I work for a living, dont have much time on computer. You act like its my fault i dont relisting fee back, i did it the only way i know this is my first time in this situation, not a pro at this. They are not going to give relisting fee back cause car didnt sell the 2nd time. I will send you that email. They gave me another site to go to i havent done that yet.

At this point I left her Negative feedback stating as I did on my reply. I have heard nothing else from her, and she now has my money, and successfully damaged my eBay reputation. She decided to put the original Negative Feedback, right after I put new auctions up.
